FLG successfully defended homeowner against breach of warranty of habitability claim, which was resolved for nuisance value shortly after a pre-trial motion was filed to the complaint.

Menasco v. Davidson

FLG represented the estate planning attorneys Davidson Estate Law against allegations of financial elder abuse, fraud, and constructive fraud brought by the estate of a deceased client. On March 15, 2023 the Alameda County Superior Court granted the lawyers of FLG motion for judgment on the pleadings as to all claims for Plaintiff’s failure to allege sufficient facts regarding Davidson’s alleged involvement in a fraud. The court also granted Plaintiff leave to amend his complaint if he could make good faith allegations to cure the defects. Plaintiff could not, in good faith, assert claims against Davidson that complied with the law, ultimately resulting in dismissal and judgment in favor of Davidson in the case.

Flake v. Neumiller & Beardsle

Jason Fellner represented the defendant's law firm in successfully obtaining an order granting a summary of judgment, which was affirmed on appeal. The Court of Appeal decision was published in 2019 and is now cited as one of the leading published cases on the tolling provision within the statute of limitations governing legal malpractice claims, codified in CCP 340.6. (Flake v. Neumiller & Beardslee (2017) 9 Cal.App.5th 223, 230)

Miller v. Murchison

Jason Fellner defended parties who were wrongfully accused of malicious prosecution. The case went to trial, was dismissed after the plaintiffs closed their case, and affirmed on appeal.
